Summary

Shelby requires a secure fence or railing along any street-facing lot edge that sits more than 18 inches above or below the adjoining street, alley, or sidewalk.

The owner of every lot, piece or parcel of ground within the city that is more than 18 inches above or below any street, alley or sidewalk and which borders on a street, alley or sidewalk shall erect and at all times maintain along the edge of such lot...a secure railing or fence sufficiently high and strong enough to keep persons and animals from falling from such lot...into the street, alley or sidewalk, or from the street, alley or sidewalk into such lot.

Under City Code Sec. 40-12, the owner of any lot bordering a street, alley, or sidewalk must erect and permanently maintain a secure railing or fence along that edge whenever the lot sits more than 18 inches above or below the grade of the street, alley, or sidewalk. The barrier must be high and strong enough to keep people and animals from falling off the lot into the right-of-way, or from the right-of-way down into the lot. Separately, Sec. 40-13 bans barbed wire fencing on any premises along a city street or alley, so a compliant safety fence in that zone cannot be barbed wire.

Violations & Fines

Civil citations run $50 for a first violation, $100 for a second, and $500 for a third and each subsequent citation for the same condition, per day, after a ten-day warning period lapses.
