5(A) sets the county's baseline: no fence may exceed eight feet in height, and none may be built on a public right-of-way or a future street right-of-way. The rule tightens for fences facing the street: any fence located adjacent to a public road and within the required front setback of a residential zoning district is capped at six feet, not eight. If a fence ends up built inside the right-of-way by mistake, the ordinance is explicit that Walton County bears no responsibility for repairing or replacing that illegal structure, so the cost of correcting an encroachment falls entirely on the property owner.

The section carves out named exceptions to the height cap: a fence or wall enclosing a sports court can rise to 12 feet within a required rear or side yard setback, subdivision entrance features can reach 10 feet, and the Board of Commissioners can condition a rezoning or special use permit approval to require taller screening walls or fences than the general limit where screening is needed. 5, effective by the November 5, 2024 amendment (Ord.
