Cal. Civil Code §841(b)(2) creates a rebuttable presumption that adjoining owners share equally the responsibility for reasonable costs of construction, maintenance or replacement of a boundary fence. A neighbor wanting to compel cost-sharing must give 30 days written notice describing the work, the estimated cost, the proposed timeline and the rationale. The other neighbor can rebut the presumption with evidence the cost is unreasonable. In Castro Valley, disputes typically go to Alameda County Small Claims Court (jurisdiction up to $12,500 for individuals). The County does not mediate.
