FL Statute Β§823.11 addresses spite fences - fences erected maliciously to annoy neighbors may be actionable as a nuisance. If a fence is on the property line, ownership and maintenance responsibility should be established between neighbors. Written agreements recommended. Disputes resolved through civil court or HOA mediation. Some HOAs require uniform fencing and dictate fence maintenance responsibilities.
