080(1) makes fence upkeep an ongoing obligation of the property owners on both sides of a fence line: fencing must be continually maintained in a structurally sound, plumb and safe condition, with regular maintenance of the fence surfaces. Repairs and patching have to use similar fencing materials so the repair blends with the rest of the fence rather than creating a mismatched patch. The code sets an objective structural trigger: a fence or wall leaning more than 20 degrees beyond plumb, or otherwise determined unsafe by the Chief Building Official, is deemed structurally unsafe and subject to correction.

Graffiti on a fence must be removed within 48 hours of appearing. 080: a building permit and engineering specifications are required for any fence built over seven feet tall, and for retaining walls four feet or taller, and any masonry wall over four feet that the Land Use Authority requires must be certified structurally sound by a Utah-licensed engineer. Where a retaining wall separates two lots, the code also allows a fence on top of it up to whatever height would otherwise be permitted at that location, so shared boundary conditions don't automatically reduce an owner's allowed fence height.
