Section 4-1, sitting in Chapter 4's general article on animals and fowl, states that the boundary lines of every lot, tract of land, or stream in the county are declared to constitute a lawful fence for the purposes of the old state fence-law chapter of Title 55 of the Code of Virginia, 1950, as amended. The provision traces to a 1939 ordinance and was carried forward through amendments in 1954, 2012 and 2016 and the 1987 recodification. In practical terms, the section answers a narrow but important question under the fence-law statutes the county references: whether an owner of livestock, or a neighbor claiming trespass or damage by a neighbor's livestock, can treat the surveyed property line itself as satisfying the 'lawful fence' requirement without a physical structure being built along it.
