Santa Maria's Good Neighbor Rules (Chapter 4-7) address fence-related neighbor issues. California law does not require neighbor consent to build on your own property. Shared fence costs may be split.
Under Santa Maria's Good Neighbor Rules (Chapter 4-7), fences must be maintained and not create nuisance conditions. California Civil Code §841 (Good Neighbor Fence Act) provides that adjoining landowners share equally the responsibility for maintaining a boundary fence. Either neighbor may request the other contribute to fence repair or replacement costs. Neighbor consent is not required to build a fence on your own property, but you may not encroach on the neighbor's land.
Fence maintenance violations are addressed through the Good Neighbor Rules. Property line disputes are civil matters.
