In Port St. Lucie all fences must be erected inside the property line as shown on the recorded plat, and the owner is responsible for maintaining both sides of the fence. In the county, a residential fence adjoining a non-residential lot may reach 8 feet.
Port St. Lucie Code 158.216(F) requires every fence to be built inside the property line as set out on the plat adopted by the City, and makes the owner responsible for maintaining the property on both sides of the fence. St. Lucie County LDC 8.00.04.B allows a residential fence to increase to a maximum of 8 feet along lot lines that adjoin a non-residentially zoned lot. There is no separate 'good-neighbor' finished-side rule; boundary disputes over exact line location are civil matters between owners.
A fence encroaching over the property line or into an easement can be ordered removed or relocated at the owner's expense.
