Polk County requires that on corner or double-frontage lots no fence be placed within the clear visibility triangle, that fences not impede drainage on or adjacent to a site, and that fence design keep with neighborhood appearance. Boundary and cost-sharing disputes between neighbors are civil matters.
LDC Section 210 directs that where property faces two roadways or is a corner lot, no fence or wall may be located within the clear visibility triangle described in Section 711, which keeps intersections visible between three and eleven feet above grade. Fences also may not be built to impede drainage on or adjacent to the site, obstruct public-safety access, or sit in the right-of-way. Fence design should be in keeping with neighborhood appearance. Polk County does not referee who pays for a shared boundary fence; that is a private civil matter.
A fence blocking a visibility triangle or drainage can be ordered removed or relocated; Polk County Code Enforcement pursues citations, fines, and liens under Florida Statutes Chapter 162.
