Massachusetts General Laws Chapter 49 governs partition fences between adjoining landowners. The law provides a fence viewer process for resolving boundary fence disputes through the local selectboard or city clerk. In Worcester, neighbors are encouraged to discuss fence plans before construction to avoid conflicts. When building on or near a property line, a survey is recommended to confirm boundaries. The finished side of the fence should face the neighbor's property. If both properties benefit from a boundary fence, costs may be shared under the fence viewer statute. The city does not mediate private fence disputes but enforces code compliance.
