A standard 6-foot residential fence does not need a planning permit in Antioch. Fences over 6 feet (up to 8 feet) in commercial/industrial districts require a Minor Administrative Use Permit; fences over 6 feet generally also require a building permit under the California Building Code as locally adopted.
Antioch's Planning Division publishes a Minor Administrative Use Permit (AUP) application specifically for eight-foot fences. The application states that an AUP is required for fences over six feet in commercial and industrial districts (8 feet maximum), and refers applicants to AMC Article 16. Processing takes approximately 3 weeks from receipt of a complete application; incomplete applications are automatically withdrawn after 120 days unless a 90-day written extension is granted by the Zoning Administrator. Submittal requirements are: a PDF site plan showing fence location, a written description of the surrounding neighborhood and why the additional height is requested (including fence materials), written property owner approval, photos and specifications of the proposed fence, and the current planning fee. Applications are submitted through the City's Civic Access Portal (antiochca-energovweb.tylerhost.net). Building permits are issued under AMC Chapter 8-1; per California Building Code §105.2 (adopted statewide) fences over 7 feet (or any masonry wall over 4 feet from the bottom of the footing) require a building permit. Applicants may also need separate clearances from the Building Division (925) 779-7065, Contra Costa County Fire Department, or Contra Costa County Environmental Health depending on the project.
Erecting a fence requiring an AUP or building permit without one can result in a stop-work order, code-enforcement citations under AMC §1-5.02, abatement at the owner's expense, and refusal to issue a Certificate of Occupancy for related construction. Applications left incomplete past 120 days are deemed withdrawn.
