California law allows property owners to build fences without neighbor consent. California Civil Code Section 841 allows neighbors to be held equally responsible for maintaining a shared boundary fence.
Under CA Civil Code Section 841, adjoining landowners share responsibility for maintaining reasonable boundary fences. Either neighbor can request the other contribute to the cost of maintaining or building a boundary fence. However, a neighbor cannot be forced to pay for an unnecessarily expensive fence. Property line disputes may require a survey.
