Many NJ municipalities require a zoning permit for fences even under 6 feet, although a building permit may not be required. Fences over 6 feet, retaining walls, and masonry fences typically require building permits per NJ UCC (N.J.A.C. 5:23). Pool barrier fences must meet NJ Barrier Subcode (N.J.A.C. 5:23-2.14(b)).
