Under the California Building Code as adopted by Orange County, a building permit is required for all fences and walls exceeding 6 feet in height from the lowest adjacent grade. Walls exceeding 6 feet must have engineered structural plans. Retaining walls over 4 feet retaining level earth, or any retaining wall impacted by surcharge loads or retaining a slope, must be designed by a licensed engineer or architect who signs the design plans, plot plan, and structural calculations. A standard fence under 6 feet on private property generally does not require a building permit but must still comply with zoning setback and height requirements under OCCO Section 7-9-137.5.
