San Bernardino County follows California Health and Safety Code 115920 through 115929, requiring all new or remodeled residential swimming pools, spas, and hot tubs to have a barrier at least 60 inches (5 feet) tall with gaps no greater than 4 inches, with a self-closing and self-latching gate opening away from the pool, and a latch at least 60 inches above the ground. At permit issuance, the pool must include at least two of seven approved drowning prevention safety features: an enclosure meeting the code, removable mesh fencing with self-closing gate, approved safety pool cover, exit alarms on doors leading to the pool, self-closing and self-latching doors with a release 54 inches above the floor, alarms installed in the pool detecting motion, or other means approved by ASTM. Pool construction requires a building permit from the Building and Safety Division. Inspections include barrier verification before final approval.
