Hamilton Township treats retaining walls as construction requiring a Uniform Construction Code permit, not as an item covered only by the zoning ordinance. Section 167-2A(15), added to the fee schedule in 2019 by Ordinance No. 19-061, sets a flat $50 construction permit fee for any retaining wall reaching a total height of four feet or more when the wall is associated with a Class 3 residential structure, the Uniform Construction Code's category for one- and two-family homes and townhouses. Shorter walls, and walls unconnected to a Class 3 residence, fall outside this specific fee line, though they may still need approval under other sections of the Building Code.

Separately, the Township's flood-hazard zoning chapter, § 536-90, classifies retaining walls as Utility and Miscellaneous Group U structures under Section 312 of the International Building Code, the same catch-all group that covers fences over six feet, private garages, sheds, tanks and towers. C. 7:13 standards. In practice, a homeowner planning a four-foot-plus retaining wall next to a house should expect to pull a construction permit from the Division of Construction Inspections, pay the $50 fee, and, if the lot sits in a mapped flood hazard area, satisfy the additional Group U and floodway conditions before work begins.
