Indio's Unified Development Code Section 3.02.10 requires retaining walls to be masonry, brick, concrete, or paver block. For permits the California Building Code controls: a retaining wall over four feet (footing to top), or any wall supporting a surcharge, requires a permit. Indio's two-foot wall exemption does not cover retaining walls.
The City of Indio addresses retaining walls in two ways. For design, Unified Development Code Section 3.02.10 (Fences, Walls, and Screening) requires that retaining walls be constructed of masonry material such as brick, concrete, or paver block, consistent with the section's broader rule against plain, unfinished concrete block. For permits, retaining walls follow the California Building Code, which the City enforces through its Building & Safety Division: a retaining wall is exempt from a building permit only when it is not over four feet in height measured from the bottom of the footing to the top of the wall, and any retaining wall that supports a surcharge (such as a slope, structure, or vehicle load above it) requires a permit regardless of height. Note the City's own FAQ exemption, fences and non-retaining masonry walls not over two feet, expressly excludes retaining walls, so a retaining wall over two feet should be treated as requiring review. Where a fence sits on top of a retaining wall, the combined structure is checked against both the retaining-wall rules and the fence height limits in Section 3.02.10. Walls must also keep a four-foot clearance around fire hydrants, water meters, and other utility structures. Confirm requirements with Building & Safety at (760) 391-4110 before grading or building.
Building a retaining wall over four feet, or any wall supporting a surcharge, without a permit can trigger a stop-work notice, an after-the-fact permit, and possible removal or retrofit. A retaining wall built of non-masonry material, or unfinished plain block, can also be cited under the design standards of UDC Section 3.02.10. Walls encroaching on the required utility clearance must be corrected.
