Retaining walls in Louisville Metro over 4 feet in height (measured from bottom of footing to top of wall), or walls of any height supporting a surcharge such as a driveway or pool, require a building permit under the Kentucky Residential Code and the Louisville Metro Department of Codes and Regulations. Engineering is required for walls over 4 feet.
The Kentucky Residential Code (based on the IRC) exempts retaining walls 4 feet or less in height that are not supporting a surcharge from permit requirements. Walls taller than 4 feet or walls supporting a driveway, patio, pool, or slope above must be designed by a licensed professional engineer or registered architect, and submitted for building permit review. Louisville Metro also requires compliance with the Metropolitan Sewer District (MSD) stormwater standards β retaining walls cannot obstruct drainage or redirect runoff to adjacent properties. Hillside properties in eastern Jefferson County (Crescent Hill, Cherokee Triangle, Indian Hills) often require engineered solutions due to the bluffs and hollows geology of the area. Setback rules under the Land Development Code may also apply; property-line walls generally must not encroach on neighbors without written easement. Walls over 4 feet also require guardrails at the top under R312 if there is a walking surface. Failure to permit can result in stop-work orders, fines, and required removal or re-engineering.
Specific penalty amounts for this ordinance are not published in a publicly accessible fine schedule. Contact Louisville code enforcement directly for current fines, enforcement procedures, and hearing options.
