Fire pit rules in Caldwell, ID β also called outdoor burning, recreational fire, or open flame ordinances β cover fuel types, clearances, and when burning is allowed.
Recreational fires, campfires and ceremonial fires are allowed in Caldwell without a permit if the fire stays under three feet in diameter and two feet high. Fire-extinguishing equipment such as a connected water hose must be readily available, and a competent adult must attend until the fire is out.
Caldwell City Code Article 17 (08-17-03) lists campfires and fires used for recreational or ceremonial purposes among the fires that are allowable without a permit, provided fire-extinguishing equipment such as a water hose connected to a supply is readily available. Under 08-17-03(4), if a recreational or cooking fire exceeds three feet (3') in diameter and two feet (2') in height, a permit must be obtained from the Caldwell Fire Department, and an inspection may be required before the permit is issued. Any such fire must be constantly attended by a competent adult until it is completely extinguished and must not create a hazard or nuisance. When a permit applies, 08-17-09 conditions take effect: no open burning within twenty-five feet (25') of any structure or combustible material, burning only between 8:00 A.M. and 7:00 P.M., piles limited to three feet by two feet, and a prohibition on all burning when the Treasure Valley air quality index reaches sixty (60) or higher or when winds exceed ten (10) miles per hour. Standard outdoor fireplaces, barbecue pits and grills used for food or recreation remain expressly allowed under 08-17-01.
Failure to comply with Article 17 is an infraction punishable by a civil penalty of not more than $100 under 08-17-11, plus possible suspension of future burn permits and injunctive action against the property owner.
