Brazoria County, TX Fire Regulations: Fire Pits & Backyard Fires (2026)

Under Section 7(7) of the Brazoria County Conduct Rules For All Parks, no person in a county park may build or attempt to build a fire except in park areas the Parks Director has designated and under regulations the Director sets. The rule gives the Director, not park visitors, the authority to decide where campfires, fire pits or grills are permitted; absent that designation, any open flame in a park is off-limits. The same subsection separately bars dropping, throwing or scattering lighted matches, burning cigarettes or cigars, tobacco paper, or other inflammable material anywhere within a park area, and extends that ban to any highway, road or street that abuts or is contiguous to the park. Smokers cannot flick a butt onto park grounds or the roadside next to a park entrance.

The fire rule sits inside Section 7, 'Behavior,' the same section that separately restricts alcohol, fireworks and explosives, so the county treats uncontrolled fire in a park as behavior misconduct rather than a stand-alone fire-code issue. Because the underlying Conduct Rules apply countywide, the restriction covers every park facility the Brazoria County Parks Department operates in the unincorporated county, not just its day-use areas.

Enforcement runs through Section 10 of the same rules: violating any provision, including the fire rule, is a misdemeanor punishable by a fine of up to $200, with each day a violation continues charged as a separate offense. Section 9(4)(f) also lets the Director revoke any permit already issued to a person found in violation, and Section 10(4) authorizes the Director or any park attendant to eject a violator from the park on the spot.
