Pennsylvania Act 43 of 2017 legalized consumer-grade (1.4G) fireworks for adults 18+, but Allentown restricts where they can be discharged. Fireworks cannot be set off within 150 feet of an occupied structure, on public property, or on someone else's property without consent. The Allentown Fire Marshal enforces local time restrictions.
Under Pennsylvania Act 43 of 2017 (72 P.S. Β§9401), Pennsylvania residents and visitors 18 and older may purchase, possess, and use consumer-grade Class 1.4G fireworks (Roman candles, bottle rockets, aerial repeaters). However, fireworks may not be ignited, discharged, or thrown: (a) on public or private property without the owner's express permission; (b) within 150 feet of an occupied structure; (c) inside any building or vehicle; or (d) by anyone under 18 or under the influence of alcohol or drugs. The City of Allentown enforces these statewide setback rules and uses its general noise ordinance (Chapter 678) and disorderly conduct (18 Pa.C.S. Β§5503) for late-night complaints. The Fire Marshal's office at 425 Hamilton Street handles permit requests for display fireworks. Display (Class 1.3G) fireworks require a permit from the city and a licensed pyrotechnician.
Discharging fireworks within 150 feet of an occupied building or on another person's property is a summary offense under PA law, punishable by fines up to $100 plus court costs for a first offense, escalating to $500. Disorderly conduct charges may apply for late-night violations. Confiscation of fireworks is common.
