Consumer fireworks are illegal to possess, use, or sell within Austin city limits. Violations can carry fines up to $2,000. Permits are issued only for professional displays by Austin Fire Special Events.
Texas state law authorizes large cities such as Austin to prohibit fireworks within city limits, and Austin enforces a comprehensive ban administered by the Austin Fire Department. Items the U.S. Department of Transportation does not classify as fireworks remain legal without a permit: snakes/glow worms (pressed pyrotechnic pellets that produce a snake-like ash), smoke devices, and wire sparklers. All other consumer fireworks - including firecrackers, bottle rockets, Roman candles, aerial shells, and mortars - are prohibited year-round, including July 4 and New Year's Eve. Public displays require an Austin Fire Special Events permit and must meet site, distance, and operator requirements.
Citation with fine up to $2,000 per violation. Fireworks causing fires or injury can lead to additional criminal charges and civil liability.
