Texas counties cannot ban fireworks outright. Under Occupations Code Ch. 2154, permitted consumer fireworks may be sold and used in unincorporated areas. The one county lever is Local Government Code 352.051: if the Texas A&M Forest Service certifies drought conditions (Keetch-Byram Drought Index of 575+), the commissioners court may prohibit or restrict 'restricted fireworks' (skyrockets with sticks and missiles with fins) in unincorporated areas, but must adopt the order before June 15 for the Fourth of July season. Cities set their own citywide discharge bans; state law separately bars igniting fireworks within 600 feet of churches, schools, and hospitals.
