Clark County, IN Fire Regulations: Fireworks (2026)

04(A) prohibits operating any sound-producing device where the noise is clearly audible 50 feet away on public or private property, but subsection (B) lists fourteen exempt categories, and (B)(7) specifically pulls out sounds associated with the use of legal fireworks or celebrations of legal holidays. 04 noise citation for the noise itself, regardless of how far it carries. Because the phrase is tied to legal fireworks, the exemption does not reach fireworks that are themselves illegal to possess or discharge under Indiana's fireworks statutes; those remain subject to whatever the state law and the State Fire Marshal's rules impose, since Clark County's own code does not add a separate county-level fireworks licensing, hours-of-use, or discharge-zone ordinance anywhere in Title 90 or elsewhere in the code.

The exemption was adopted as part of the countywide noise ordinance under Ord. 11-2004, passed July 29, 2004, and the Sheriff and Board of Commissioners retain joint authority under subsection (C) to issue implementing rules for the noise chapter generally.
