Idaho lets consumers buy and use only 'nonaerial common fireworks' (ground spinners, fountains, sparklers, smoke devices, snakes). Aerial and firecracker-type fireworks are not legal for general use. Sale/use is limited to June 23-July 5 and Dec 26-Jan 1.
Under Idaho Code 39-2602(6), nonaerial common fireworks stay on or near the ground and do not travel outside a 15-foot circle, land material outside a 20-foot circle, or exceed 20 feet high; they do NOT include firecrackers or jumping jacks. Some retailers sell aerial 'dangerous' fireworks after a buyer signs an affidavit they will not be used in Idaho, but the Idaho Attorney General has said such affidavits are not required by law and do not make consumer use of aerials legal. Sale and use is limited to midnight June 23-July 5 and midnight Dec 26-Jan 1. During fire season the county commission or fire district may ban fireworks in severe-fire-threat areas with advance notice.
Selling or using fireworks outside authorized dates is an infraction with a $100 fine; other violations are misdemeanors and fireworks may be confiscated (Idaho Code 39-2609, 39-2613).
