Full Breakdown
Section 7-1-5 of the Elko County Code is a two-part prohibition adopted by the Board of County Commissioners in 1965. Subsection (A) covers discharge: it is unlawful for any person to wilfully handle or discharge, explode or cause to be discharged or exploded any firecrackers, roman candles, skyrockets or other fireworks at any place within the boundaries of the county. The text excepts specifically the use of sparklers and fusees. A second exception covers public displays by organized groups and associations, and it carries one condition: firefighting equipment must be available at the time of the display. The exception names groups and associations, not individuals.
Subsection (B) covers commerce. It is unlawful to sell, offer for sale, exchange or barter, or give away any fireworks, firecrackers, Roman candles, sky rockets or any and all pyrotechnical displays of any name or nature, except fusees and sparklers. Giving fireworks away is covered, so a gift at a family gathering falls inside the ban the same as a retail sale. The Elko County Sheriff's Office enforces Title 7, the Police Regulations.
The discharge penalty is printed in the section itself: a misdemeanor with a fine not to exceed three hundred dollars or imprisonment not to exceed three months in the county jail, or both. The sale penalty reads only that the violator is guilty of a misdemeanor and punished accordingly, so the numbers come from the chapter penalty section. Section 7-1-26 provides for up to six months in the County Jail or a fine not to exceed one thousand dollars, or both, and lets a convicted person who agrees perform up to one hundred twenty hours of community work in place of all or part of the punishment. The code applies in unincorporated Elko County, Nevada; the cities of Elko, Carlin, Wells and West Wendover have their own codes.
