Chapter 107 of the Lower Paxton Township Code, the Lower Paxton Township Fireworks Ordinance, was adopted by the Board of Supervisors on 5-22-2019 by Ord. No. 19-01 and works alongside the Pennsylvania fireworks law, Act 43 of 2017. Section 107-5 allows a person at least 18 years of age to purchase, possess and use consumer fireworks, then lists eight prohibitions.
Nobody can ignite or discharge consumer fireworks on any Township property, including streets, sidewalks, public parks or public buildings. On private property the person needs the express, written permission of the owner. Consumer fireworks or sparkling devices cannot be used within, or thrown from, a motor vehicle or building, or fired into or at a motor vehicle, building or another person, or used by someone under the influence of alcohol, a controlled substance or another drug. Discharge is barred within 150 feet of an occupied structure and on a property of less than one acre in area.
The time limits are 10:00 p.m. at night and 7:00 a.m. in the morning, prevailing time, unless otherwise permitted by the Township. The exceptions are New Years Eve, which runs until 12:00 midnight, New Years Day until 12:30 a.m., and July 4 until 11:00 p.m.
Display fireworks are a separate track under § 107-3. Discharge requires a permit, applications must be made in writing at least 30 days before the display, the initial application fee is $75 per permit, and no permit can be issued to a person under 21. The permittee must post a bond of not less than $50,000 for damages. If weather cancels the display, § 107-4 lets the permittee request an extension within 24 hours, to a date no later than one week after the original date, without an additional fee.
Violations & Fines
Section 107-6 has any Township police officer or Code Enforcement Officer, as assigned by the Township, enforce the chapter. A person who violates any provision can be issued a citation for each offense with a fine of $100 for each offense, so a single night with several violations, such as discharging within 150 feet of an occupied structure and after 10:00 p.m., produces separate citations.
