Alabama legalizes 1.4G consumer fireworks statewide, but the City of Madison (Sec. 18-3) makes it unlawful to discharge fireworks or light a bonfire inside city limits except by permit. Novelties and sparkling devices (sparklers, poppers, snakes) are allowed anytime.
Ordinance 2024-137 (adopted May 28, 2024) repealed and replaced Sec. 18-3. Discharging, throwing, or setting off any fireworks, or lighting a bonfire, within the city is unlawful without a permit, as is possessing, storing, selling, or handling them. However, 'novelties' and 'sparkling devices' as defined in Ala. Code 8-17-210 (party poppers, snappers, snakes, wire sparklers, ground-based non-aerial sparklers) may be sold and used at any time. The Fire Chief may suspend even those during drought or hazardous conditions. Statewide, Alabama permits DOT Class C common (1.4G) fireworks (Ala. Code 8-17-217), so the city ordinance controls what is legal locally.
Fireworks used in violation are subject to seizure and destruction by the City. State-law violations are a Class A misdemeanor: $100-$1,000 fine and/or up to one year (Ala. Code 8-17-224).
