Palm Beach Gardens, FL Fire Regulations: Fireworks (2026)

Section 46-17(c), adopted by Ord. No. 12, 2011, section 1 (Exhibit A), on October 6, 2011, is part of Chapter 46's Article I general prohibitions for city parks and recreational facilities. The subsection opens by noting that any and all state and county restrictions on fireworks or fireworks items continue to apply within the city, then specifically prohibits the use, ignition, lighting or display of fireworks in all city parks unless the display is part of a city-authorized fireworks show or performance. The same section separately restricts thrown-object games under subsection (a) and skateboarding, bicycling and similar wheeled activity under subsection (b), placing fireworks among the activities the city treats as unsafe for its park system generally rather than folding it into the fire prevention chapter.

Because Chapter 46 sets no fine of its own, a violation of subsection (c) is punished under the Code's general penalty at Sec. 1-18: a fine of not more than $500.00, imprisonment for not more than 60 days, or both, and each day a violation continues is treated as a separate offense. Enforcement rests with Palm Beach Gardens Police Department officers on patrol and Parks and Recreation Division staff, who can stop an unauthorized fireworks display on the spot at any city park. The only lawful fireworks use in a city park is a display the city itself has authorized as part of a permitted event or performance; personal or family fireworks use, even sparklers or novelty items, is not exempted by the section's text.
