Florida Statute 791.08 lets residents use consumer fireworks on New Year's Eve, New Year's Day, and Independence Day, but Pinellas County's local rules historically required county permits even on those days. Public displays require a permit from the county fire marshal, certified pyrotechnic operators, NFPA 1123 compliance, site approval, and proof of insurance. Sparklers approved by the State Fire Marshal remain lawful.
