Pismo Beach, CA Fire Regulations: Fireworks (2026)

Section 8.08.010 AA amends California Fire Code Section 5601.1.3 to read that the possession, manufacture, storage, sale, handling and use of fireworks, including without limitation Safe and Sane fireworks, are prohibited. The ban lists six activities and names Safe and Sane fireworks expressly. The single exception is use and handling of fireworks for professional display in accordance with Title 19, California Code of Regulations, Chapter 6, and with a written waiver from the Fire Code Official approving the public display. Under § 8.04.020 the Fire Chief is the fire code official.

Added Section 5601.1.3.1 gives the fire code official the authority to seize, take and remove fireworks stored, sold, offered for sale, used or handled in violation of Title 19, California Code of Regulations, Chapter 6 and California Health and Safety Code, Chapter 9. Added Section 104.5.1 grants the fire code official, or a duly authorized agent, the authority under Section 836.5(a) of the California Penal Code to issue citations, and Section 103.3.1 gives the chief and designated members of the California Department of Forestry and Fire Protection/Pismo Beach Fire Department the authority of peace officers or public officers in performing their duties under the California Fire Code.

The beach has its own rule. Section 12.20.070 makes it unlawful for any person to possess, store, offer for sale, sell at retail or wholesale or use or explode any fireworks within the beach safety zone and play area, subject to the exception it cross-references in Chapter 8.08. Fireworks used in filming are handled in the film chapter: § 5.44.150 requires the applicant to obtain a fire permit from the city fire department during the filming of any special effect or stunt requiring pyrotechnics, including fireworks, open flames or explosives.
