Florida law (FS 791.08) lets residents use consumer fireworks on New Year's Day, July 4, and December 31. Osceola County cannot ban fireworks on those three days. Any other day, only sparklers and novelties are legal without a permit.
Since a 2020 change, FS 791.08 declares that Chapter 791 "does not prohibit the use of fireworks solely and exclusively during a designated holiday." The designated holidays are New Year's Day (Jan 1), Independence Day (July 4), and New Year's Eve (Dec 31). On every other day, only state-approved "sparklers" and novelties (FS 791.01) may be sold and used without an agricultural/display permit. Local governments and HOAs may still impose reasonable time-and-place limits, but cannot eliminate the right to use fireworks on the three holidays. A county burn ban does not override the fireworks-holiday right but strongly discourages ignition sources.
Illegal sale/use of consumer fireworks outside the three holidays is a first-degree misdemeanor under FS 791. HOA covenants may impose separate fines.
