Lawful construction in unincorporated Osceola County is exempt from the noise limits only between 7:00 a.m. and sunset. Construction noise outside those hours is not exempt and must meet the standard dBA limits at the property line.
Osceola County Code § 9-110(h)(12) exempts "lawful construction activity conducted between the hours of 7:00 a.m. and sunset" from the general noise limits. Outside that window construction has no exemption and must comply with § 9-110(a): 45 dBA at the property line after sunset. The exemptions also cover lawn mowing and gas or electric lawn, garden and household tools between 7:00 a.m. and sunset (§ 9-110(h)(13)), refuse collection vehicles, and golf-course maintenance equipment from 5:30 a.m. to sunset. A seven-day temporary permit (§ 9-115) can authorize otherwise-prohibited noise for temporary activities.
Construction noise outside 7 a.m.-sunset that exceeds limits is a code violation enforceable by code officers or police under chapter 7, heard by the code enforcement board or special master.
