Florida §791.08 (as amended by SB 140 in 2020) preempts most local fireworks regulation and allows consumer fireworks on July 4, December 31, and January 1. Kissimmee Fire Department enforces the Florida Fire Prevention Code for fireworks displays under Sec. 24-19.
Florida HB 1043 / §791.08(8) (2020) allows consumer fireworks on Independence Day, New Year's Eve, and New Year's Day notwithstanding any local ordinance — Kissimmee cannot prohibit them on those three dates. On other days, consumer fireworks are limited to 'sparklers' as defined in §791.01(7). Permitted public displays must follow NFPA 1124 / 1126 as adopted by Sec. 24-19, with permit issuance by the Kissimmee Fire Marshal. The HOA preemption in §791.06 does not apply — HOAs can still restrict fireworks under their CC&Rs even on permitted state dates. KPD and Code Enforcement responded to large volumes of complaints around 2024 Fourth of July weekend.
Illegal fireworks discharge (outside the three permitted dates) is a first-degree misdemeanor under F.S. §791.06: up to 1 year in county jail and $1,000 fine. Sec. 1-22(b)(21)–(24) fire-code violations carry $150-$200 city fines.
