South Carolina Code Title 23, Chapter 35 (Fireworks) is one of the most permissive fireworks laws in the United States. Consumer fireworks classified under DOT 1.4G, including bottle rockets, Roman candles, and aerial repeaters, are legal to sell and possess. Sellers must obtain a state license from the State Fire Marshal and meet storage and structural requirements. Buyers must be at least 16 years old. The Act preempts any local ordinance that bans the sale of consumer fireworks; however, counties and municipalities retain authority to regulate the time, place, and manner of discharge, including discharge near structures or during burn bans.
Selling fireworks without a license or to underage buyers is a misdemeanor punishable by up to 30 days jail and fines up to $200; repeat offenses may result in license revocation.
