Although South Dakota legalizes the sale and use of consumer (1.4G) fireworks statewide during seasonal windows under SDCL Chapter 34-37, the City of Sioux Falls prohibits the possession, sale, and discharge of fireworks within the corporate city limits under its home-rule authority. Violation is a Class 2 misdemeanor under Sioux Falls Code. The ban applies year-round, including July 4 and New Year's Eve. Sparklers, snakes, smoke devices, and other novelties are also covered.
South Dakota Codified Laws Chapter 34-37 legalizes consumer fireworks (1.4G) statewide for sale (June 27–July 5 and December 28–January 1, per SDCL §34-37-5) and personal use, but SDCL §34-37 expressly leaves municipal authority intact for local discharge regulation. Sioux Falls, operating under its home-rule charter adopted under SDCL Chapter 6-12, has enacted a comprehensive ban on possession, sale, and discharge of fireworks within the city under Title 130 of the city code. Permitted public displays (1.3G professional) are allowed only with a city permit issued through Sioux Falls Fire Rescue and the Fire Marshal, and only by licensed pyrotechnicians under IFC Chapter 56. Each individual firework discharged constitutes a separate offense. Sioux Falls Police and Sioux Falls Fire Rescue both enforce the ban; complaints are taken via the city's non-emergency dispatch (605-367-7000). The ban is one of the most strictly enforced 'quality of life' ordinances during late June through early July each year.
Discharging, selling, or possessing fireworks within Sioux Falls city limits is a Class 2 misdemeanor under the city's general penalty provisions, punishable by up to 30 days in jail and/or a fine up to $500 per offense. Police may also seize fireworks. Property owners can be cited for fireworks discharged on their property.
