Unlike most California counties, unincorporated Sutter County permits state-approved 'safe and sane' fireworks during the July 4 period. 'Dangerous' fireworks (firecrackers, rockets, mortars, aerials) are illegal everywhere, and a county dangerous-fireworks ordinance imposes a $1,000 fine plus a possible misdemeanor.
Sutter County is one of the relatively few California jurisdictions where 'safe and sane' fireworks are legal in unincorporated areas. State and local fireworks lists identify unincorporated Sutter County, plus the small communities of Sutter and East Nicolaus, as places where State Fire Marshal-approved 'safe and sane' fireworks may be sold and used, alongside the cities of Yuba City and Live Oak. Under California's State Fireworks Law (Health & Safety Code section 12500 et seq.), 'safe and sane fireworks' are devices tested and approved by the State Fire Marshal that do not fly into the air or explode (fountains, ground spinners, snakes). Anything classified as a 'dangerous firework' under HSC 12505 (firecrackers, sky rockets, Roman candles, aerial shells, and sparklers over the size limits) is illegal in California without a state permit. In 2019 Sutter County adopted a dangerous-fireworks ordinance establishing a $1,000 administrative fine and a possible misdemeanor charge, which can be assessed against both the person who discharges illegal fireworks and the owner, renter, or person in possession of property where dangerous fireworks are knowingly used. Enforcement is handled by the Sheriff, county fire, code enforcement, and development services. Officials describe a 'zero tolerance' policy and conduct heavy enforcement around the holiday.
Illegal (dangerous) fireworks: $1,000 administrative fine and possible misdemeanor charge under the county's 2019 ordinance; property owners/renters can be held responsible when dangerous fireworks are knowingly discharged on their property. State-level violations of the Fireworks Law can carry additional penalties.
