All fireworks are illegal in the City of Tustin, including state-classified "Safe and Sane" fireworks. There is no legal window to buy or discharge fireworks anywhere in the city. The City of Tustin offers a public Fourth of July fireworks display as a legal alternative.
Tustin is a total-ban city for consumer fireworks. According to the City and the Tustin Police Department, all fireworks are illegal within the City of Tustin, including so-called "Safe and Sane" fireworks that California classifies separately from "dangerous fireworks." "Safe and Sane" fireworks are devices approved and labeled by the California State Fire Marshal under California Health and Safety Code section 12529, but California law lets each city ban them, and Tustin has done so. That means no fireworks may be sold, possessed, or set off anywhere in the city, even around the Fourth of July. Tustin Police have stated that violators could face an infraction citation, a misdemeanor arrest, or a felony arrest depending on the type of firework involved. The Police Department's GRADE (Gang Reduction and Directed Enforcement) units are deployed on high alert around July 4 to enforce the prohibition, and the department regularly receives a surge of fireworks-related calls on the holiday. Fire protection in Tustin is provided by the Orange County Fire Authority (OCFA). The City traditionally sponsors an official public Fourth of July fireworks show, which is the only legal way to enjoy fireworks within Tustin. Residents who see illegal fireworks should contact Tustin Police rather than attempt to handle it themselves.
Possessing, selling, or discharging any fireworks (including Safe and Sane) is illegal. Penalties range from an infraction citation to misdemeanor or felony arrest depending on the type of firework, per Tustin Police. Enforcement is heightened around July 4.
