28 limits lawful fireworks to "safe and sane fireworks" bearing the State Fire Marshal seal and defined under California Health and Safety Code Section 12529 (Sec. 070). citywide (Sec. 160(A)); outside that single day and window, selling, purchasing, possessing, storing, using or discharging any fireworks of any kind is unlawful (Sec. 160(B)). that day (Sec. 080). Only federally certified 501(c)(3) nonprofits based in Garden Grove may hold a stand permit, issued by the Finance Director alongside a required Orange County Fire Authority permit (Sec. 020).

The City caps total stand permits at 30 per year, one stand per organization except schools, which may operate up to three (Sec. 050). Applications are due by March 31st and must include a distributor's information, a State Fire Marshal Retail Fireworks License, a sales tax permit, and a plot plan; each permittee must carry commercial general liability insurance of at least $1,000,000 per occurrence naming the City as additional insured (Sec. 110). Stands cannot locate within 1,000 feet of Garden Grove Park, Twin Lakes Park or Village Green Park, must have two exits, an approved Class 2A fire extinguisher, and no overnight sleeping by staff (Sec.

120-150). Discharge or use of safe and sane fireworks within 10 feet of any residence, dwelling or structure is prohibited, as is any fireworks use on commercial, industrial or publicly owned parcels absent a Community Event Permit (Sec. 160(F), (I)). Sales to, or use by, anyone under 18 without adult supervision is also barred (Sec. 160(C)-(E)). Permit denials, suspensions or revocations may be appealed in writing to the City Clerk within 10 days for de novo review by the City Manager, whose decision is final (Sec. 170).
