Garden Grove, CA Noise Ordinances: Aircraft Noise (2026)

Garden Grove Municipal Code Section 8.47.070, the exemptions section of the noise control chapter, excuses three categories of activity from every standard in Chapter 8.47: emergency operation and repair of essential public services and utilities under subsection (A), licensed community events like school bands, dances, and athletic events under subsection (B), and, under subsection (C), motor vehicle and aircraft operations and any other activity whose regulation has been preempted by state or federal law. That third exemption means the city does not attempt to set decibel limits, curfews, or ambient-noise standards for airplanes, helicopters, or other aircraft operating over or near Garden Grove, including traffic tied to nearby John Wayne Airport in Orange County.

Federal aviation law occupies the field of flight-path and engine-noise regulation, so a city noise ordinance has no legal reach over a pilot's or airline's operations; residents bothered by overflight noise have to pursue relief through the airport authority, the FAA's noise complaint process, or state-level channels rather than the Garden Grove Police Department or Building Official who otherwise enforce Chapter 8.47. The same subsection also removes ordinary street and highway motor vehicle noise from the chapter, since vehicles on public roads are separately regulated by the California Vehicle Code.
