Full Breakdown

Section 6-9-1 of the Twin Falls City Code starts from a ban: it is unlawful for any person in the city to import, export, offer for sale, give away, sell, possess, keep, store or permit the keeping or storing of any fireworks, or to fire, discharge or display any fireworks, except as Chapter 9 provides. The chapter then opens two permit lanes, both run through the Twin Falls fire department.

Safe and sane fireworks are the nonaerial common kind, such as ground spinners, fountains, sparklers, smoke devices and snakes designed to remain on or near the ground. Section 6-9-2 excludes firecrackers and jumping jacks from that category. Dangerous fireworks include skyrockets and bottle rockets, Roman candles and cakes, aerial display shells and sky lanterns. Under § 6-9-3(A), dangerous fireworks can be possessed only by a holder of a dangerous fireworks permit for a safely supervised public display, with storage limited to ten days before the display.

Section 6-9-8 sets the calendar. Retail sale runs from 12:00 midnight June 23 to 12:00 midnight July 5, and from 12:00 midnight December 26 to 12:00 midnight January 1. The authority having jurisdiction can extend each sales period by not more than five days. Use is limited to 8:00 A.M. to 12:00 midnight on June 23 through July 5 and December 26 through January 1, with an added window from midnight to 1:00 A.M. on January 1.

Sellers pay the Twin Falls fire department a $25 application fee and a $25 inspection fee for each temporary stand under § 6-9-4(A), and a public display of dangerous fireworks carries a $125 application fee. Each permit applicant files public liability insurance of at least $500,000 under § 6-9-7. Under § 6-9-9, retail sales happen only from a temporary stand, no more than 750 square feet, at least 25 feet from any other building and 100 feet from any gasoline station, staffed by a supervisor twenty one or older. No stand can go up before June 10, and the site must be cleared by noon on July 27.

Violations & Fines

Under § 6-9-15, possessing or discharging dangerous fireworks without a dangerous fireworks permit is an infraction with a $100 fine, and so is using safe and sane fireworks outside the designated dates and hours. All other violations of the chapter are a misdemeanor with a fine of up to $300 and imprisonment of up to six months, or both. The chief of police or his agents can confiscate illegal fireworks under § 6-9-14, and the city council can revoke a permit after at least one day notice of hearing under § 6-9-13.
