Consumer fireworks are banned in the Town of Vienna and throughout Fairfax County. Despite Virginia legalizing consumer fireworks statewide in 2021, localities retain authority to prohibit them, and both Vienna and Fairfax County have kept a near-total ban. Only sparklers, fountains, and other non-aerial, non-explosive novelties are permitted, and even these are restricted to private property.
Town of Vienna Code and Fairfax County Code Chapter 62 prohibit the sale, possession, storage, transportation, and discharge of consumer fireworks within town and county limits. This is an exception to Virginia's generally permissive statewide fireworks framework. Under VA Code 27-95 through 27-100.1, localities may ban fireworks that are otherwise lawful statewide, and Fairfax County has exercised that authority to maintain a long-standing ban. Prohibited items include firecrackers, bottle rockets, skyrockets, Roman candles, aerial shells, mortars, torpedoes, chasers, and any firework that explodes, rises into the air, or travels laterally. The only items generally permitted are non-aerial, non-explosive novelties such as wire sparklers, cylindrical or cone fountains, pharaohs serpents, and caps for toy pistols, provided they are not thrown or set off on public property or highways. Discharging legal sparklers and fountains on a public street or sidewalk is still prohibited. Professional aerial displays, such as the Vienna Fourth of July fireworks at Yeonas Park or Southside Park, require a permit issued by the Fire Marshal and must be performed by a licensed pyrotechnician under SFPC Chapter 56 standards. Violations are Class 1 misdemeanors, punishable by up to twelve months in jail and a $2,500 fine, plus civil liability for any resulting injury or property damage. Fire Marshals may issue enhanced enforcement around July 4 and New Year's Eve. The $0.12 per unit state fire safety fee applies only where fireworks are legally sold, not in Vienna.
