Brooklyn Park, MN Fire Regulations: Outdoor Burning (2026)

City Code Sec. 07 flatly bans open burning "except as otherwise permitted by this section," and it is the Fire Chief or the Chief's designee who decides whether to issue a permit and what conditions to attach. Only five categories qualify: training fires run by the Fire Department, fires that eliminate a hazard no other method can abate, forest and game management burns, land-clearing or right-of-way maintenance burns and accepted agricultural practices, and any fire the Chief otherwise deems necessary. Applicants must submit a site diagram showing the burn point, nearby buildings, roads and overhead lines, and pay the permit fee set by City Council resolution before the Chief signs off; the Chief also coordinates standby fire apparatus at application time, and a granted permit is good for that purpose and time period only and cannot be transferred.

Material restrictions bar burning oils, rubber, plastics, treated or painted wood, composite shingles, tar paper, insulation, sheetrock, wiring, asbestos, paint or paint filters, along with hazardous waste, industrial or commercial solid waste, demolition debris, or food-preparation discards. Location rules keep any burn at least 600 feet from a road, high-power line or occupied structure other than one on the burn property, at least one mile from an airport absent written approval, and at least 50 feet from other combustibles, which must be cleared before ignition.

Wind cannot exceed 10 mph or blow toward residences, and a person familiar with the permit limits must attend the fire with extinguishing equipment until it is completely out. The permit holder answers for every cost the burn generates, including suppression and administrative fees.
