Open burning of household waste, trash, and land-clearing debris is prohibited across East Baton Rouge Parish. The Baton Rouge Fire Department states it is illegal to burn parish-wide, with narrow exceptions for permitted vegetative land-clearing and recreational/cooking fires.
Two layers of law apply. State regulation LAC 33:III.1109 bars burning waste or combustible material on your property; in parishes over 90,000 population (which includes East Baton Rouge), burning household waste is not allowed at all, and only vegetative matter may be burned under strict conditions (8 a.m.-5 p.m., winds away from town, 1,000 feet from other dwellings). City-Parish Code sec. 5:31 separately bans starting a fire to clear land within the parish (outside municipal limits) and within 1,000 feet of an established subdivision without a valid permit. Under City-Parish Code, violation is a misdemeanor. Sec. 5:36 penalty: fine of $200-$500, imprisonment up to 30 days, or both. DEQ may also assess penalties.
