Summary

Every occupied dwelling or dwelling unit in the Town of Cary must have at least one operable smoke detector outside the sleeping areas, near the ceiling, under the town's Minimum Housing Standards article.

(1) The owner or operator of every occupied dwelling or dwelling unit shall provide each dwelling or dwelling unit with at least one operable smoke detector installed outside the sleeping areas, to be located on or near the ceiling. (2) Detectors shall be electrically or battery operated and shall provide an audible alarm when activated.

Full Breakdown

Sec. 8-126(f) puts the duty on the owner or operator: install at least one operable smoke detector outside each dwelling's sleeping areas, on or near the ceiling, either electrically wired or battery-operated with an audible alarm. "Operable" means functional when a battery is inserted or power is on, but neither owner nor landlord must supply electricity or replacement batteries. Where the state building code requires an electrical detector instead, that code controls. Carbon monoxide detectors are required separately under state law. Missing detectors also make housing "unfit" under Sec. 8-118(c)(11).
