The North Carolina Residential Code, adopted under N.C.G.S. 143-138, requires a building permit for any retaining wall exceeding four feet in height measured from the bottom of the footing to the top of the wall, or for walls supporting surcharge loads. Walls over four feet generally require sealed engineering plans by a licensed professional engineer under N.C.G.S. 89C. Erosion and sediment control requirements under N.C.G.S. 113A-50 also apply during construction.
Unpermitted retaining walls may require removal, retroactive engineering certification, and trigger civil penalties under both building code and erosion control statutes.
