Cincinnati Municipal Code Chapter 1235 requires approved smoke detectors in every residential dwelling. Detectors must be installed on every floor, especially outside sleeping areas, with alarms audible through closed bedroom doors. The Cincinnati Fire Department offers free smoke alarms.
Cincinnati Municipal Code Chapter 1235, titled Detectors and Early Fire Warning Systems, is part of Title XII (Cincinnati Fire Prevention Code) and mandates that all residential occupancies be equipped with an early fire warning system. Smoke detectors approved by the fire code board must be installed in the immediate vicinity of but outside all sleeping rooms, and the alarm signaling device must be clearly audible in all bedrooms with intervening doors closed. Detectors are required on every level of the dwelling including the basement. For new construction and substantial renovations, hardwired interconnected smoke alarms with battery backup are required under the Ohio Residential Code. Existing homes that have not undergone renovation must at minimum have battery-operated smoke detectors in the required locations. Property owners and landlords bear responsibility for ensuring detectors are installed and functional at the time a tenant takes occupancy. Tenants are responsible for maintaining detectors during their tenancy, including replacing batteries. The Cincinnati Fire Department, in partnership with the American Red Cross, provides free smoke alarms to residents who request them through Cincinnati 311. Requests are filled on a rolling basis. The Fire Prevention Bureau can be reached at 513-357-7585 for questions about compliance. Violations of Chapter 1235 can result in fire code citations and are a common finding during rental property inspections.
