Smoke alarms are required in all Herndon dwellings under the Virginia Uniform Statewide Building Code (USBC) and the Virginia SFPC. Alarms must be installed in every bedroom, outside each sleeping area, and on every level of the home. Rental properties face additional inspection and testing requirements under VA Code §36-99.3.
Smoke alarm requirements in Herndon flow from the Virginia Uniform Statewide Building Code (USBC), which adopts the International Residential Code and International Fire Code with Virginia amendments, and from VA Code §36-99.3 for rental housing. New and substantially renovated single-family homes must have hardwired, interconnected smoke alarms with battery backup installed in every sleeping room, outside each separate sleeping area in the immediate vicinity of bedrooms, and on each additional story of the dwelling including basements and habitable attics.
Existing dwellings that predate interconnection requirements must, at minimum, have functioning battery-powered or 10-year sealed lithium battery smoke alarms in the same locations. When a dwelling is sold, alarms must be tested and functional at transfer under the Virginia Residential Property Disclosure Act. For rental properties, VA Code §36-99.3 requires the landlord to install and maintain approved smoke alarms, and tenants must not disable them. Landlords must provide a certificate of compliance upon tenant request and may inspect alarms annually.
Carbon monoxide alarms are required in any dwelling that contains a fuel-burning appliance or an attached garage, installed outside sleeping areas. Combination smoke and CO alarms are permitted. Alarms should be replaced every 10 years regardless of battery status, as sensor components degrade. The Herndon Fire Marshal and Fairfax County Fire and Rescue run periodic free smoke alarm installation programs for residents who cannot afford or install their own. Commercial occupancies, multi-family buildings, and short-term rentals face additional monitored fire alarm system requirements under the SFPC.
