The Oxnard Building Division enforces the California Residential Code (CRC) sections R314 and R315 as locally adopted. Smoke alarms must be installed inside each sleeping room, outside each separate sleeping area in the immediate vicinity of bedrooms, on every story (including basements and habitable attics), and at least 36 inches from supply registers, ceiling-mounted paddle fans, and bathrooms with a tub or shower. Carbon monoxide alarms are required outside each sleeping area and on every level for any dwelling with a fuel-burning appliance, fireplace, or attached garage. Statewide, Cal. Health & Safety Code Sec. 13113.7 obligates owners of single-family dwellings to install operational smoke alarms and to certify they are in place at sale or transfer. When the value of additions, alterations, or repairs exceeds $1,000, Oxnard requires that listed and approved alarms be installed throughout the unit per R314/R315; new construction requires hardwired, interconnected alarms with battery backup. A self-certification affidavit is filed for permit closeout.
Selling or transferring a dwelling without functioning smoke alarms violates Cal. H&S Code Sec. 13113.8 and exposes the seller to a civil penalty of up to $200. Failed inspections block permit final. Landlords face Civil Code Sec. 1941.1 habitability claims for missing alarms.
