West Virginia requires all mobile food units to obtain a permit from the local health department under state Bureau for Public Health rules. The Mobile Food Establishment Reciprocity Act allows operators with one county permit to operate statewide without duplicate inspections.
Under WV Code §16-1 and 64 CSR 17 (Food Establishments rule, based on FDA Food Code), every mobile food unit operating in West Virginia must obtain a permit from a local health department. Operators must demonstrate access to a commissary or approved support kitchen, have approved water and waste systems, and pass equipment and sanitation inspection. The Mobile Food Establishment Reciprocity Act (WV Code §16-1-9c) requires local health departments to honor a permit issued by another West Virginia local health department, eliminating duplicate inspection fees. Certified Food Protection Manager certification is required for at least one operator. Local zoning still controls where trucks may park or vend.
Operating without a permit is a misdemeanor punishable by fines and immediate closure. Permits may be suspended or revoked for sanitation violations or imminent health hazards.
